Citizen Of Mexico Pleads Guilty to Third Illegal Reentry Offense In CT

A Mexican national with a long rap sheet has pleaded guilty in Connecticut to illegally re-entering the country after being deported twice, violating the conditions of his supervised release for a prior conviction for the same offense.

Jose Del Carmen Hernandez Hernandez, 41, has pleaded guilty to one count of illegally reentering the United States after being deported. He has never held a legal status in the country, John Durham, the United States Attorney for the District of Connecticut, noted.

Between 1999 and 2009, Hernandez was convicted of various felonies, including assault, threatening and operating a motor vehicle under the influence. In April 2009, he was first deported to Mexico. Hernandez then went on to re-enter the states, returning to Connecticut. He was subsequently arrested on charges of evasion and criminal mischief.

Hernandez was again arrested in Hartford in March 2013, on a breach of peace and criminal mischief charge. He was identified by federal immigration officials and convicted in federal court of reentry of a removed alien. He was deported again the following year in April.

Durham said that Hernandez went on to reenter the country a second time and returned to Connecticut. He was arrested in November 2015 in Hartford for a DWI. He was again sentenced to a year in prison and was deported to Mexico in May last year.

Hernandez went on to reenter a third time last year, and on Jan. 11, he was arrested for multiple vehicle violations, including a DWI in Hartford. He has been detained since his arrest. He will face a maximum term of 10 years in prison for illegal reentry and a maximum term of two years for violating his supervised release. He is scheduled to be sentenced on Oct. 30.
