Eric Benitez, 33, was charged with first-degree criminal trespassing and disorderly conduct. He was held on $5,000 bond and went to court Monday.

Police were called to a Highwood Avenue home just before 1 a.m. Monday on a report of a disturbance. The caller said that her daughter and her daughter's ex-husband had gotten in a fight, and the ex-husband was now outside and refusing to leave, police said.

Officers arrived and met Benitez, who was reportedly intoxicated, and he said that he wanted to talk to his ex-wife but she wouldn't talk to him, police said.

The officers spoke to the complainant, who said Benitez was ringing the doorbell and knocking on the door in an effort to talk to her daughter, police said.

When nobody opened the door, he kicked it, then went around the side of the house, climbed on a grill and went into the window, according to police.

Benitez started yelling at his ex-wife, who called his parents to come pick him up, police said. He grabbed the phone and threw it at a dresser, then went back out the window, according to police. His parents arrived, but he still refused to leave, police said.

When officers asked Benitez whether he had climbed through the window, he reportedly said, "Of course I did. What are you going to do, arrest me?"

He was then placed under arrest.
