Matthew Hazuda and Rahul Mathew, both now 21, were originally detained on juvenile complaints after the girl told her parents they'd assaulted her on Aug. 10, 2011.

A judge last year waived both to adult status following a request by prosecutors.

On Monday, Presiding Superior Court Judge Susan J. Steele rejected a bid by attorneys for both men to try their clients separately and dismiss aggravated sexual assault charges against them.

Hazuda and Mathew have remained free on bail since the case was waived up in October 2014.

Bergen County Prosecutor John L. Molinelli previously said the alleged victim gave his investigators a “detailed account “ of being “forcibly engaged in inappropriate sexual activity…while she was highly intoxicated and unable to consent to such activity.”
